There had been a great deal of discussion on the 14th amendment and its effect on Public Debt. In researching the Amendment, I found something that might be a legal issue to the ratification. The facts are:
- The North had ratified the 14th Amendment but it did not have enough votes to meet the 3/4 approval requirement in the Constitution.The Southern states had rejected the Amendment. Congress considered the Southern Sates as still in the Union and thus, they needed their votes to meet the 3/4 approval of states.
- The Congress passed the Reconstruction Act of 1867. It virtually expelled the Southern States from the Union and put them under Martial Law.
- According to the Reconstruction Act of 1867, one of the requirements given to the Confederate States was to ratify the 14th Amendment. This had to be done prior to being considered for readmission to the Union.
IF the Confederate States had to approve the 14th Amendment in order to be readmitted to the Union, their ratification was illegal since they approved the amendments while they were no longer full and participating States in the Union.
So my question to you is:
Was the 14th Amendment legally ratified? Food for thought!!!
